KPpay, recognizes that the protection of its intellectual property is essential to its commercial success and competitive advantage. This policy is intended to protect our intellectual assets, including our platform, websites, applications, and other content created or owned by KPpay.

  • Protect KPpay's intellectual property assets from unauthorized use, disclosure or misappropriation.

  • Users: Any person accessing KPpay websites, applications or services, including customers, visitors and partners.

Scope of application

  • All employees of KPpay and K-POLYGONE FINTCH SARL.

  • Contractors, consultants and business partners .

  • Users of KPpay websites, applications and services.

Ownership of intellectual property

KPpay assets

  • Website and Application content: The general structure of the www.kppay.com, www.k-polygone.com and www.k-polygone.org websites, as well as the texts, graphics, images, sounds, videos, logos, databases, software and all other elements making up these websites and applications are the exclusive property of KPpay or its partners.

  • Legal Protection: These elements are protected by applicable intellectual property laws and regulations, in particular by Togo's Intellectual Property Code.

Employee creations

  • Work Performed in the Course of Employment: Any invention, work, creation, development or improvement made by an employee in the course of his or her duties or with the use of KPpay resources is the exclusive property of KPpay.

  • Assignment of Rights: Employees irrevocably assign to KPpay all right, title and interest in and to such creations, including intellectual property rights, without limitation as to time or territory.

Use of intellectual property

Use by Users

  • Limited License: KPpay grants users a limited, non-exclusive, non-transferable license to access and use the Websites and Applications for personal, non-commercial use in accordance with the Terms of Use.

Restrictions:

  • Unauthorized reproduction: Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site or the application, by any means whatsoever, is prohibited without the prior written authorization of KPpay.

  • Hypertext links : The creation of deep hypertext links to any element of the KPpay sites other than the home page is prohibited without the prior written authorization of KPpay.

Internal use

  • Authorized Access: Employees may use KPpay's intellectual property assets only in the course of their duties and for business purposes.

  • Protection of Information: Employees must protect confidential information and not disclose it without prior authorization.

Third-party use

  • Licenses and Agreements: Any use of KPpay intellectual property by third parties must be subject to a written agreement, such as a license or partnership agreement, approved by management.

  • Reporting: Immediately report to management any violation or suspected violation of KPpay's or third parties intellectual property rights.

Third-party intellectual property

  • Respect for Third-Party Rights: KPpay is committed to respecting the intellectual property rights of third parties. Employees and users must avoid any unauthorized use of intellectual property assets belonging to third parties.

Enforcement and penalties

  • Non-compliance: Any violation of this policy may result in disciplinary action for employees, including dismissal, and legal action for offending users or third parties.

Applicable law and jurisdiction

  • Applicable Law: This policy is governed by the laws of the Republic of Togo, including provisions relating to intellectual property.
